Effective date: 28 August 2026. These Terms & Conditions (“Terms”) are an agreement between you and Key West Sun Shirts (“we”, “us”) covering your use of www.keywestsunshirts.com and any purchase you make from it. By using the site or placing an order you accept these Terms and our Privacy Policy. If you do not agree, please do not use the site.
1. Who can order
You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract. We sell and ship only within the United States. If you create an account, keep your password private and tell us straight away if you think someone else has used it; you are responsible for activity under your account.
2. Our products
- Made to order. Each shirt and hat is printed to order after you buy it. That is why processing takes a few business days and why cancellations are limited (see section 4).
- Colours and images. We photograph and describe our products as accurately as we can, but screens differ and printed colours can vary slightly from what you see. Minor variation is not a defect.
- Sizing. Please check the size guide before ordering; fit differs by style, and the women’s crop tops run snug.
- Sun protection. Our sun shirts use UPF 50+ rated fabric. UPF applies to covered skin only. It is not a substitute for sunscreen, hats, shade or eye protection, and no garment prevents all UV exposure.
3. Prices, tax and promotions
- All prices are in US dollars and exclude shipping and any applicable sales tax, which are shown at checkout before you pay.
- We may change prices at any time; the price you pay is the one shown when you place your order. If a product is listed at an obviously wrong price, we may cancel the order and refund you in full.
- Promotional codes have the conditions stated with them, cannot be combined unless we say so, and have no cash value. Free shipping on orders over $75 applies to retail orders shipped within the United States.

4. Orders, acceptance and cancellation
- Your order is an offer to buy. We accept it when we send the order confirmation email; we may refuse or cancel any order (for example for suspected fraud, pricing errors, stock or production problems, or a delivery address we cannot serve). If we cancel after you have paid, we refund you in full.
- Because items are printed to order, you can cancel or change an order only before it enters production. There is no fixed window. Production can begin as soon as the same day, so email info@keywestsunshirts.com immediately with your order number and we will tell you whether it can still be changed. Once production has started, the order is covered by the returns policy (section 7) instead.
- Check your shipping address carefully. If a parcel is returned to us because the address was wrong or the delivery was refused, we will contact you about re-shipping at your cost.
5. Payment
We accept major credit and debit cards and the other methods shown at checkout. Payment is taken when you place the order. Card details are entered directly into our payment processor’s secure form and are never stored on our servers. By providing a payment method you confirm you are authorised to use it.
6. Shipping and delivery
Orders are normally produced within 5–7 business days and standard delivery within the US takes a further 3–5 business days; faster options are offered at checkout. Delivery estimates are estimates, not guarantees, and can be affected by carrier delays, weather and holidays. You receive tracking by email when your order ships. Title and risk of loss pass to you when the carrier delivers the parcel to the address you gave. Full details are on the Shipping & Returns page.
7. Returns, exchanges and refunds
- If you are not happy with your purchase you may return it within 30 days of delivery for a refund or exchange, provided it is unworn, unwashed and in its original packaging. Email us first so we can approve the return and send instructions.
- Return shipping is at your cost unless the item is faulty or we sent the wrong item. In that case we send you a prepaid return label and, once the item is back with us, replace or refund at our expense.
- Refunds go to the original payment method, normally within 10 business days of our receiving and checking the item. Original shipping charges are not refunded unless the return is our fault.
- Nothing in this section limits any rights you have under law.
8. Our designs and content
The artwork on our products, and all text, photographs, logos, designs and other content on this site, belong to Key West Sun Shirts or our licensors and are protected by copyright and trademark law. You may browse the site and share links, but you may not copy, reproduce, print, sell or create derivative works from our designs or content without our written permission. “Key West Sun Shirts” and our logo are our trademarks.
9. Reviews and content you send us
If you post a review, send us a photo, or otherwise give us content, you confirm it is yours and truthful, and you give us a non-exclusive, royalty-free, worldwide licence to use, display and adapt it in connection with our business (for example on the site or in our marketing), crediting you by first name where practical. We may remove content that is offensive, misleading or infringes someone’s rights. Reviews you leave on independent review platforms are governed by those platforms’ terms.
10. Acceptable use
You agree not to use the site in a way that is unlawful, infringes anyone’s rights, introduces malicious code, attempts to gain unauthorised access, scrapes content or product data without permission, places fraudulent orders, or interferes with the site’s operation or other people’s use of it. We may suspend or close accounts and refuse orders that breach these Terms.
11. Third-party links and services
The site links to and embeds services run by other companies (for example review platforms, social networks and the payment form). We are not responsible for their content or practices; their own terms and privacy policies apply when you use them.
12. Warranties and disclaimers
We warrant that products will match their description and be free from defects in materials and workmanship on delivery; section 7 sets out your remedy if they are not. Beyond that, and to the fullest extent the law allows, the site and products are provided “as is” and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the site will be uninterrupted or error-free. Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Key West Sun Shirts and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from the site or products, even if we were told they were possible. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence, or for fraud. Some states do not allow these limitations, so they may not apply to you.
14. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the site, or content you provide that infringes someone else’s rights.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. If you have a problem, please contact us first. Most issues are resolved quickly and informally. Any dispute that cannot be resolved that way will be brought in the state or federal courts located in Monroe County, Florida, and you consent to their jurisdiction, except that either party may bring an eligible claim in small-claims court. Nothing in this section stops you from using any consumer-protection rights available where you live.
16. General
These Terms, the Privacy Policy and the Shipping & Returns page are the whole agreement between us about the site and your orders. If any part is found unenforceable, the rest still applies. If we do not enforce a term on one occasion, we can still enforce it later. We may transfer this agreement as part of a sale of the business; you may not transfer it. We are not responsible for delays caused by events outside our reasonable control, such as severe weather, carrier disruption or supply problems.
17. Changes to these Terms
We may update these Terms from time to time and will show the new effective date at the top. Changes apply to orders placed after they are posted; the Terms in force when you ordered apply to that order.
